Hire Agreement Terms

All hired machinery remains at all times the property of IronPlantHire. 

Deposits will be required prior to delivery, and depend on the machine hired. Please enquire for rates.

1. The Hirer will keep and maintain the hired Equipment during the terms of the rental at their own cost and expense. The equipment will be used in a good and careful manner, complying with manufacturer's requirements and recommendation. 
2. To the extent permitted by law, the Hirer will be responsible for risk of loss, theft, damage or destruction to the Equipment from any and every cause. 
3. The Hirer is liable to pay the Owner full compensation for replacement / repair of any equipment which is not returned because it was; lost, stolen or any equipment which is damaged and in need of repair to return it to the same condition it was in at the time of rental. Normal wear and tear excepted. The Owners invoice for replacement or repair is conclusive as to the amount the Hirer shall pay under this paragraph for repair or replacement.  
4. At the end of the Term or upon earlier termination of this Agreement, the Hirer will make the Equipment available for pick up. If the Hirer fails to make the Equipment available for pick up, the Hirer will pay to the Owner any unpaid Rent for the Term. 
5. The Hirer will, for the entirety of the Term and whilst under the Hirer’s possession of the Equipment have valid and current insurance against loss of and damage to the Equipment for the full replacement value of the Equipment (listed above) and will name the Owner as the loss payee. 
6. The Hirer shall not remove the equipment from the address of the Hirer or the location shown here as the place of use of the equipment without the written consent of the Owner. The Hirer shall inform the Owner upon demand of the exact location of the equipment whilst it is in the Hirer’s possession.  
7. The Hirer understands and confirms they know how to use the equipment and to wear all required PPE. The Owner will not be responsible for any damages to property or persons involved. 
8. The Hirer agrees to return the equipment in suitably clean condition and with a full fuel tank as delivered. Failure to do so will incur a £50 cleaning fee (per item) and a £30 flat rate fuel charge will be taken from the deposit.  

We appreciate that sometimes accidents can happen so we have put together a bit of information for our users on why we include a requirement to hold an insurance policy. 

Within the plant hire industry it is standard practice for the Hirer to organise their own insurance for hired equipment. This responsibility includes the entirety of the Hirer's possession of the machine, including any time waiting for the equipment to be collected. Although 'normal wear and tear' is considered acceptable, the Hirer is responsible for all site damage.

We strongly advise anyone hiring plant equipment to undertake a risk assessment, especially when hiring larger equipment. This should extend to theft as the potential financial implications of the theft of a 0.5Ton Dumper and a 1.5Ton Excavator would be in excess of £15,000. Its with this in mind that we include in our terms that our customers hold valid insurance as should damage or theft occur then the Hirers would be liable for the cost of replacing the lost or damaged equipment and loss of hire charges until a settlement had been received. If Hirers are planning on using their current building or contents insurance to cover plant hire we would advise they check with their insurance provider, and we would require written proof of this.  

We want to ensure that the hire process is as easy as possible for you, and that you and your project are covered for any situation. These are only recommendations and hiring will not be effected if you take out a policy using another insurer.
